Ford Motor Credit Company, LLCI’m not 100% certain of all the details surrounding the story, but I know mom basically stopped making car payments on her Ford and they repossessed it. I am pretty sure — if I remember correctly — that I am the one that insisted she stop making payments on it, because she simply didn’t have the money to afford it and she wasn’t driving because she had no car insurance.

She had gotten in a car accident in late 2009 and that was when I should have — but did not — realize that something was dramatically and terribly wrong with her. She had been complaining about problems with her memory even before the accident, but things started to really go downhill after it. And at the time of the accident, I later learned, she had already let her car insurance lapse. It ended up being a disaster because the guy who hit her (or the guy she hit, depending on which story you believe) kept trying to get her to pay for his repairs.

Eventually Ford did repossess the car, I think. Although I don’t know. Maybe it’s still sitting abandoned in a parking lot of one of the two or three apartment complexes where she lived before she was institutionalized. But they were also understandably tenacious about attempting to collect on the debt. There were many threatening letters and phone calls, and I know she was scared that she was going to be sent to jail.

This morning, while looking through the four notices listed below, I found a phone number for the law firm representing Ford. I called and talked to a man who gave me a fax number and asked me to send him a copy of the death certificate. I did that a few minutes ago.

Subpoena Duces Tecum for Deposition in Aid of Execution
August 15, 2011: This document pretty sternly “commands” that mom appear for a deposition on October 26, 2011 at some law office in Daytona Beach, and that she bring with her all of her bank statements for the previous twelve months, copies of her state and federal tax returns, pay stubs, etc. It also notes that if she fails to appear she would be held in contempt of court. (She did not go to the deposition.)

Sheriff’s Return of Service
October 7, 2011: This is a copy of a log officially stating that Ben F. Johnson, SHERIFF in Volusia County, supports the claim that Process Server Tammy Baldwin served mom the Subpoena / Duces Tecum for Depo in Aid of Execution on October 4, 2011 at 10:30 AM.

Certificate of Non-Appearance
October 27, 2011: The Registered Merit Reporter and Notary Public certified that mom failed to appear at the deposition on October 26th.

Motion for Contempt
November 22, 20122: This was filed against mom for failing to appear for a deposition regarding her debt with Ford Motor Credit Company, LLC. It requests that mom be sentenced to five days in county jail unless she pays $200 in fees, plus “any other fees”, and complies with the subpoena to be deposed. I have no idea if she ever saw this letter; but it was only a few days after this that she was found crying and lost in the parking lot of her apartment complex. The manager of the apartment complex was unable to contact me or my little sister and so she called the police, who took mom to the hospital, who sent her to Stewart-Marchman ACT, where the onslaught of psychopharmaceuticals began, from which she never recovered.

(1) Can you tell me the date that Woodland Terrace was first made aware of our request for my mom’s medical records? I have been in contact with WT regarding the records. They are hesitant on releasing the records because your mother is deceased and you have not been appointed the PR of her estate by a court. We have taken the position that they have the authorization to discuss your mother’s medical care and chart with you. Their attorney is reviewing their position.

(2) Can you tell me for how long you’ve been waiting for a response from the Woodland Terrace attorney? I discussed this with them about 2 weeks ago. I expect a response one way or the other soon.

(3) Are you also awaiting the receipt of medical records from Halifax Medical Center and / or Florida Hospital DeLand (Fish Memorial Hospital)? Had you requested medical records from either of those facilities? I cannot remember. I did not request these. Dr. Wolf needs to review the last 30 days of treatment records and the intake treatment plan from the facility which should be very comprehensive.

Just before two o’clock in the afternoon of November 1st, 2012, attorney Steve Phillips finally replied to one of my emails. By this point I had emailed or called him over a dozen times, so his comment that he “must have missed the one e-mail” was very annoying.

 
 
Communication Breakdown?

As of today, November 1st, 2012, it’s been a full three weeks since I last heard from Steve Phillips, the attorney from Pincus & Currier LLP who is helping me deal with mom’s case.

I sent him this email just now, and in it I included my previous two (unanswered) emails:

Radiology Associates

I found a bill for mom from a place called Radiology Associates. The statement shows it was for something labeled MRI BRAIN WO/W CONTRAST administered at HMC (which I correctly assumed to be Halifax Medical Center) on January 20th, 2012. The amount due is $275.00 and it was supposed to have been paid by 02/25/2012.

I called and talked to a woman named Kennetta who told me she was very sorry for my loss and asked me to fax a copy of the death certificate to her and she would take care of it. So that’s what I did.

Volusia Hospitalist LLC

I am slowly and methodically working my way through a huge stack of bills and other paperwork for mom. This morning I found a statement from Volusia Hospitalist LLC dated 03/08/2012. The statement shows the name Mohammad Khan, MD and seems to be for services rendered on January 20th, 24th, and 26th, and February 29th. The total is $505.00.

I called the number on the bill — (386) 676-0255 — but nobody answered the line and it sounded like a generic mobile phone voice mailbox. I left my name and number and said that I was calling about a statement that was overdue. I suppose I’ll simply move it to the bottom of the pile for now.

Florida Hospital DeLand

Fish MemorialI found a bill from Florida Hospital DeLand among the stacks of paperwork my sister pulled from mom’s desk. The bill is for $2,169.84 for her visit there on December 1st, 2011. That was the true “beginning of the end” for mom; it hurts to even see that date.

I called the number on the bill, but it was for a debt collection service in Michigan, where they told me they wouldn’t be able to help me at all and I needed to call the hospital billing department directly. The woman there gave me a number to call and warned me that the phone system was very confusing, so I should just ignore it and try to get an operator to route my call.

I called and she was correct. The phone options — Press 1 for this, Press 2 for that — made very little sense to me. Pressing zero just started the recording again. Eventually I just hit four, which seemed like the closest thing to billing. The woman that answered the phone was very nice. She said that I needed to fax a copy of mom’s death certificate to their billing department, and to please include a letter stating that mom has “no assets in probate”, whatever that means. I did that this morning.

Seventy-Seven Days

Kathie GagneIt’s been seventy-seven days since mom died. Eleven weeks seems like forever and at the same time it seems like yesterday. I still can’t believe that she’s dead. It still hurts more than I can explain. I miss her so much.

She was only 63 when she died, which is way, way too young. She could have easily lived another twenty years. She should have lived long enough to get to know her beautiful grandson, to read more books, to write more, to tell more jokes and laugh more. I’m old enough to know that life isn’t fair, but it’s hard — so hard — not to want to scream, “Why?”

Knowing is one thing, but it’s nearly impossible, for me, at least, to accept that life isn’t fair.

Today also would have been my maternal grandmother’s 92nd birthday. She died five years ago last May and it devastated mom in a way I could never have understood until now.

J.C. Christensen and Associates, Inc.

J.C. Christensen and Associates, Inc.I found a “Notice of Collection and Special Offer” from J.C. Christensen and Associates, Inc. for $1170.23, addressed to mom and dated February 8, 2012. It notes that their client is Cavalry Portfolio Services and that Cavalry contracted J.C. Christensen and Associates, Inc. with regard to a delinquent HSBC Bank Nevada N.A. \ Orchard Bank account. I suspected that this is another company trying to collect the same bill that I handled earlier this week, but I still called them to confirm.

A man answered the phone and asked how he could help me. I told him that I was calling regarding a bill addressed to my mother, who passed away about two months ago. He asked me if I had an account number and — after I read it to him from the bill — he put me on hold for about two minutes. When he returned he told me that the account was not in their system, and that, “you should Google Cavalry and get their number,” to talk to them about the bill.

I didn’t need to Google the number because I had just talked to them on Tuesday, so I called Cavalry. A man answered and I explained to him that I was calling to confirm that the bills were the same. I gave him the account number on the bill and he told me I needed to talk to someone in the compliance department. Then he put me on hold for about two minutes and a woman answered and asked how she could help me. Frustrated, I explained the whole story again: That my mom had passed away about two months ago, that I had talked to someone there on Tuesday about it and how I had another bill that looked to be for the same thing, but it was from a different collection agency and I wasn’t 100% certain they were the same account and I didn’t want to leave any loose ends … She told me that I needed to talk to someone in the compliance department.

I said that I thought she was in the compliance department, and that I had just been on hold waiting for the compliance department after telling the previous person that same story. She said she was sorry that she couldn’t help me and immediately put me on hold for another two minutes.

The next woman who answered the phone asked, without any introduction or pleasantries, if I was the executor of Kathleen Gagne’s account. I said that I was her oldest son and I was handling her affairs. The woman asked me if I had power of attorney or any documentation and I explained that both my mom’s parents were deceased, that she wasn’t married, and that I was her oldest descendent, which gives me de facto power of attorney. She asked me if I had a copy of the death certificate and I said I did.

She said she’d need to see a copy of death certificate before she could give me any information about the account. I told her I didn’t want any information about the account and I was calling just to confirm that this was the same account I’d already addressed on Tuesday. She asked me for the account number on the bill from J.C. Christensen and Associates, Inc. and I gave it to her; she told me that, yes, it was the same one and it had already been closed.

I asked her if she’d like me to fax her a copy of the death certificate, and noted to her that they hadn’t asked me to do that on Tuesday. She said it wasn’t necessary because, “we’ll get that automatically.” I have no idea who she thinks is going to fax them a copy of mom’s death certificate, but whatever; that’s not my problem. I told her I was happy to fax it to her if it would help them close the account and she gave me her fax number. And I faxed it.
