Three days after my mother died, someone at Woodland Terrace sent me a sympathy card. I received it when we returned to Los Angeles from Florida on the 28th.

The front of the card states:

WITH DEEP SYMPATHY DURING THIS DIFFICULT TIME

Inside is written, “To the family of Kathleen Gagne,” above the text:

PLEASE KNOW THAT GOD’S LOVE SURROUNDS YOU AT YOUR TIME OF PAIN, AS DOES MINE. IF I CAN HELP, PLEASE KNOW THAT I’M HERE FOR YOU.

It’s signed by Cherry, Rebecca, Heather, Angelyne, Marilyn, Vanessa, Sylvia, Susan M., Ashley, Erica, Ida, and “Social Services”. Most of them added, “Sorry for your loss,” or something similar.

Looking at it makes me nauseous.

Steve Phillips

TelephoneA little after lunch on August 15th, 2012, I called Steve Phillips, an attorney who is an acquaintance of my father-in-law’s best friend. He did not answer, so I left him a very brief message asking him to return my call and telling him how I’d been referred to him.

An Update from Detective Whittier

Detective Whittier of the Deland Police Department called me at 9:20 AM EDT. We had a very long phone call in which I updated him on all of the phone calls I had yesterday.

He told me that he was planning on going to visit Woodland Terrace tomorrow to attempt to talk to Dr. Peele in person.

We spoke for twenty-nine minutes.

Update: As of 12:10 AM EDT on August 18th I have not heard from Detective Whittier.
All About Risperdal

JanssenHere are some notes about Risperdal, the drug prescribed to my mom by Dr. Mossler — a psychiatrist who saw my mom only one time — exactly one week ago, which I declined, and which — when I learned they were ignoring me and administering to her anyway — I begged and pleaded with them to stop giving her less than twenty-four hours before she died.

Risperdal is a product of Janssen 5, a pharmaceutical company owned by Johnson & Johnson.

Studies have shown that older adults with dementia … who take antipsychotics (medications for mental illness) such as risperidone have an increased risk of death during treatment. 1
Risperidone is not approved by the Food and Drug Administration (FDA) for the treatment of behavior problems in older adults with dementia. Talk to the doctor who prescribed this medication if you, a family member, or someone you care for has dementia and is taking risperidone. 1 2
Atypical antipsychotics like Risperdal are definitely associated with sudden cardiac death. 3
“In the absence of clearly established benefits for many of these patients, the risk of a fatal side effect is not likely to be acceptable. For these patients, the use of antipsychotic medications should be reduced sharply […]” 4
The benefits of Risperdal in children, the elderly, or people taking it for off-label reasons (i.e. something other than schizophrenia or bipolar mania) have not been established; therefore, the unproven benefit is not worth the proven risk. 3

A Call from Dr. Hermann

I received a phone call 1 from Dr. Marie Hermann, the chief medical examiner of Volusia County. I quickly — quickly — gave her a summary of the events of the last week and told her that I couldn’t understand why Bob Burch would be so adamant that her office would not perform an autopsy.

Volusia County Medical ExaminerShe told me that she would be out of the office tomorrow morning because she had a meeting in another city, but that she would review the case in the afternoon. She said that she, “needs to see things in writing,” and that there may be things that I do not know. She said, “It’s up to me to make that decision.” I explained to her how I called, begging the nursing home to stop administering Risperdal, and about how in the last nine months I have seen an uninterrupted string of terrible mistakes made by hospitals, doctors, and nurses, including even an ordeal involving unsterilized equipment using during a colonoscopy at Halifax. Dr. Hermann said, “I am not the medical hospital police;” that her job wasn’t to “go after” people who had made mistakes, but just to decide whether there was justification for her office to perform an autopsy, which would be based on medical records.

She said that so far she didn’t have the information she needed to make that decision, and that someone would contact me tomorrow. 2 I apologized to her for calling her so late in the day and for taking up so much of her time. I asked her if she thought Bob Burch would be upset with me for “going over his head” and calling her directly, and she told me that she didn’t think so; she said that she understood that I was simply doing what I needed to do to get answers.

I let Dr. Hermann know that I was here in Sanford, Florida even though my phone number has a California area code.

I thanked her and said goodbye.

The entire call lasted seventeen minutes.

Calling Dr. Hermann

A friend of mine managed to uncover what is apparently the personal cell phone of Dr. Marie Hermann, the chief medical examiner for Volusia County and the person Bob Burch told me would ultimately be responsible for deciding if an autopsy would be performed on my mother’s body.

I called the number and she answered, “Hello?”

I asked if this was Dr. Hermann and she said that it was. I said, “Hello, Dr. Hermann. My name is David Gagne and I’m calling about arranging an autopsy for my mother, Kathleen, who passed away on Sunday.”

She asked me, “Okay, are you at the number you’re calling me from?” and then said the area code of my phone. I confirmed that was my number and she said that she was driving right now, but would return my call in about twenty minutes.

I thanked her as profusely and earnestly as I could and she said, “Okay,” and we hung up.

Updating Detective Whittier

I called Detective Whittier of the Deland Police Department and left him a message to let him know that I had talked to Bob Burch at the office of the Medical Examiner for Volusia County and I wanted to update him.

I also, obviously, wanted to know if he had heard anything from the ME’s office or from Investigator Brown or anyone else.

Trying to Get an Autopsy Performed

Volusia County Medical ExaminerI called the office of the Volusia County Medical Examiner at (386) 258-4060 1 and the phone was answered by Lis. 2 She was listening and seemed interested as I began explaining to her that I was attempting to get more information about what I needed to do to get them to perform an autopsy on my mother. The instant I mentioned Bob Burch, however, she said that she would need to transfer me to him if he was handling the case.

I waited on hold for just a moment and then Bob came on the line. He said, “Bob Burch,” and I said, “Hello, Bob. It’s David Gagne, we spoke yesterday.” I told him that I had spoken with Dr. Peele at about eleven-thirty this morning and that he had told me that he still refused to sign the death certificate because he didn’t know why or understand why my mother died and that he wanted an autopsy performed.

Bob told me that he, too, had spoken to Dr. Peele this morning, and that, “even if Dr. Peele requests one, an autopsy will not be performed.” I asked him why and he said that the funeral home hadn’t contacted him, and that they are the ones who need to initiate the death certificate. I told him that I had talked to Mr. Cusack at the funeral home and he hadn’t mentioned anything about that, and that we already knew that Dr. Peele was refusing to sign the death certificate. The hospital where my mom died told me that he refused to sign it and Dr. Peele himself told me that he refused to sign it.

Bob said that he had heard that as well, but that he only had our word on that. Somehow the fact that Dr. Peele had told that to Bob as well was irrelevant, which makes no sense at all to me. Bob said that the medical examiner’s office cannot take jurisdiction of the body until they hear from “vital statistics”, 3 and that vital statistics hadn’t contacted him.

Bob Burch told me that Dr. Peele needs to refuse the funeral home’s request for him to sign the death certificate. 4 He said that if the funeral home has an issue, they will call him, and at that point “we’ll decide if we need to bring in the body and move on.” I asked him what he meant by the phrase “move on” and he said it’s up to the medical examiner to decide if she wants to do an autopsy. I asked Bob who the medical examiner is and he said her name is Dr. Marie Hermann.

Bob then said, “It’s likely that one will not be done.”

I asked, “Why do you say that one will not be done?”

Bob replied, “Because of the medical history that your mother has.”

I asked Bob if there was any way to get in contact with her and he said, “Right now, no, because we have not taken jurisdiction.” Bob told me, though, that Dr. Hermann had been “briefed” on my mother’s case. I asked, “By whom?” and he said, “By me. She’s my boss.”

Bob then asked me for my phone number, which I gave to him.

He said that his recommendation was to … and then he interrupted himself and asked, “Which funeral home is she at?” I told him that she was at Cusack Mortuary in Deland. He said that I should “let them bring her in.” 5.

Then he said, “This will be resolved by tomorrow afternoon.”

I said, “So you’re going to call the funeral home now?” and he replied, “No, I’m going to call him in the morning.”

I asked him if there was any other information I could give him and he said, “No. I’ve got all I need.”

I thanked him and said goodbye.

Contact with Dr. Peele

I called the cell phone number I have for Dr. Peele. 1 I did not expect him to answer, but he did. I said that I was Kathie Gagne’s son and that both a nurse at Fish Memorial Hospital and Dr. Allen Cusack, the manager of the mortuary where my mother’s body is currently located, had told me that he was refusing to sign the death certificate.

Dr. Peele said that he was, “very sorry to hear about your mother, but I’m not sure why she died.” He said, “We would like to know why she died,” why she was so confused and in the state that she was. He said that it could have been a psychological problem, but “we could only get yes or no answers” out of her at Woodland Terrace.

I told Dr. Peele that I had talked to Bob Burch at the office of the medical examiner of Volusia County, and he had told me that he couldn’t do an autopsy unless Dr. Peele refused to sign the death certificate, but that didn’t make any sense because Dr. Peele was clearly refusing to sign it.

Dr. Peele said that he would call and ask for Bob Burch. 2

He then said, “I really don’t know why she died. I think an autopsy will help us all.”

Dr. Peele told me that he would call me and confirm when he contacted the medical examiner’s office. 3
